Terms
1. Who we are and how these terms work
Carolina Melendez (“Carolina Melendez,” “we,” “us,” or “our”) welcomes you. We invite you to access and use our website carolinamelendez.co (the “Website”).
These Terms of Use, together with our Privacy Policy (which is incorporated here by reference), form a binding agreement between you and us (this Agreement). By browsing the public parts of the Website, or by registering, purchasing, or otherwise using it, you confirm that you have read, understood, and agree to be bound by this Agreement. If you do not agree, please do not use the Website.
If you register an account or buy a product or service, you also agree to the specific Terms and Conditions of Purchase that apply to that product or service. If those purchase terms conflict with this Agreement, the purchase terms control for that purchase.
We may update these Terms of Use from time to time (see the section on changes below). The version in force is the one published on the Website when you use it.
Who uses the Website:
- Visitors — people who use the Website without registering. Visitors can view publicly available content and contact us.
- Registered Users — people who create an account. Registered Users can do everything Visitors can, and also buy products and services, access members-only content, manage their account, post comments or other material where we allow it (User Content), sign up for programmes and notifications, and take part in our community.
We are not obliged to accept any registration and may accept, decline, suspend, or close an account at our reasonable discretion, including where these Terms of Use have been breached. Where you are a consumer, we will not close your account in a way that deprives you of rights you have already paid for, except as allowed by law.
2. Who can use the Website (age and capacity)
The Website is intended for adults. You may use it only if you can form a binding contract under the law of your country.
Minimum age to use the Website is 16, unless a higher age of majority applies where you live, in which case that higher age applies for purchases and for agreeing to these terms. If you are between 16 and the age of majority in your country, you may use the Website only with the involvement and consent of a parent or legal guardian, who agrees to these terms on your behalf.
Children and data. We do not knowingly market to or collect personal data from children below the age of digital consent that applies to them. Under the EU GDPR this age is 16, though some EU/EEA countries set it lower (down to 13); in Brazil the LGPD gives special protection to the personal data of children and adolescents; and ASEAN data-protection laws (such as Singapore's PDPA) require consent from a parent or guardian for a minor. How we handle these ages is explained in our Privacy Policy. If you believe a child has given us personal data without the proper consent, contact us at contact@carolinamelendez.co and we will delete it.
3. Your account and security
To register, you create a sign-in name and password, and you may give us extra information to verify you when you log in. When you register, you must give true, accurate, current, and complete information, and keep it up to date.
Each account is for one person. Do not share your sign-in details, and do not let anyone else use your credentials to access content we provide, doing so is a serious breach of this Agreement, especially where it gives others access to paid or proprietary content.
You are responsible for keeping your credentials confidential and for activity that happens under your account. Tell us promptly at contact@carolinamelendez.co if you need a password or sign-in name deactivated, if you change any verification detail, or if you suspect unauthorised use of your account.
We may change or deactivate your password, sign-in name, or verification details where we reasonably need to for security. Where this is not urgent, we will give you reasonable notice. We are not liable for loss you suffer from a security step we take in good faith, except to the extent the law does not allow that limit (see the liability section).
4. Prices and payment
When you buy something on the Website, you agree to pay the price shown plus any applicable taxes.
Prices and taxes. Prices are shown before you confirm your order. Depending on where you are, prices may include or exclude VAT, GST, sales tax, or similar — this is stated at checkout. Where we must charge VAT or another indirect tax (for example to consumers in the EU/EEA, the UK, or jurisdictions with similar rules), it is added as required by law.
Currency. Payments are taken in the currency shown at checkout. If your card or bank converts to another currency, your bank's exchange rate and any foreign-transaction fee apply, and those are between you and your bank.
Authorisation. You authorise us, or our payment processor, to charge your chosen payment method for the full amount due. You must give current, complete, and accurate billing details and keep them up to date. If a card expires, you authorise us (where our processor supports it) to charge any replacement card for the same amounts, for example to continue a subscription you have signed up for.
Failed or disputed payments. If a payment is not received, we may suspend access to the paid content until it is resolved. Where you genuinely owe us money and do not pay, we may recover it, including reasonable costs of recovery permitted by law. Nothing here limits your right to dispute an incorrect charge with us or your bank.
Subscriptions. If you buy a recurring plan, it renews and is charged each cycle until you cancel, and we will tell you clearly before you sign up. You can cancel future renewals as described at checkout or in your account; cancelling stops future charges and does not, by itself, refund the current period unless the law or our refund policy says otherwise.
5. Cancellation, withdrawal, and refunds
Your cancellation rights depend on where you live and what you bought. The rights below are minimums set by law; where our published refund policy is more generous, that applies.
Consumers in the EU/EEA and the UK — right of withdrawal. If you are a consumer, you generally have 14 days to withdraw from a purchase made at a distance, without giving a reason, starting from the day of purchase (for digital content and services) or delivery (for goods). To withdraw, tell us a clear statement of your decision at contact@carolinamelendez.co before the 14 days end; you may use the model withdrawal form but do not have to. We will refund you within 14 days of being told, using the same payment method.
- Important — digital content. For downloadable or streamed digital content (courses, videos, downloads), the law lets you give up this 14-day right so you can get immediate access. At checkout we will ask you to (a) expressly consent to immediate access and (b) acknowledge that you then lose the right of withdrawal. If you give that consent and we begin supplying the content, the 14-day withdrawal right no longer applies.
- Services already started. If you ask us to start a service during the 14 days and then withdraw, we may charge for the part already provided.
Consumers in Brazil — right of regret (CDC art. 49). If you are a consumer in Brazil buying off-premises (including online), you have 7 days from the purchase or from first access to cancel and receive a full refund, regardless of the rules above. To exercise it, contact us at contact@carolinamelendez.co within 7 days.
Other countries. If your local consumer law gives you a cooling-off or cancellation right, that right applies to you even where this section is silent.
Statutory guarantees. Separately from any cooling-off right, if a product or service is faulty, not as described, or not of satisfactory quality, you may be entitled to a repair, replacement, price reduction, or refund under the consumer law that applies to you. These rights are not affected by this Agreement.
How to request a refund. Email contact@carolinamelendez.co with your order details. Refunds go back to your original payment method unless we agree otherwise.
6. Our content and intellectual property
The Website contains material such as videos, course materials, lesson plans, training modules, text, graphics, images, audio, software, and other content (the Content). The Content is owned by us or by third parties who have licensed it to us, and it is protected by copyright, trademark, and other laws in the United Kingdom and internationally.
What you may do. Visitors may view publicly available Content for their own personal, non-commercial use. Registered Users who have bought a product or service may access and, where we allow it, download the Content included in that purchase for their own personal, non-commercial use.
What you may not do. Except as set out above, or as allowed by mandatory law, you may not copy, reproduce, republish, sell, rent, licence, sub-licence, distribute, publicly display or perform, adapt, translate, create derivative works from, or otherwise commercially exploit the Content without our prior written permission. You must keep any copyright and ownership notices intact. Posting the Content on another website, app, social-media account, or shared network for any purpose is not allowed.
If you breach this Agreement, your permission to use the Content ends immediately and you must delete any copies you have made.
Trademarks. Our names, logos, and brand features, including Carolina Melendez, are our trademarks (registered or not). Other names and logos on the Website may belong to third parties. Nothing on the Website grants you a right to use any trademark without the owner's prior written permission.
7. Your content and the licence you give us
Where the Website lets you post, upload, or submit material — comments, posts, images, and similar (User Content) — the following applies.
You own your content. You keep the copyright and other rights in your User Content. You are responsible for what you post.
It may be public. If you post User Content in a public area, others may see and use it as the feature allows, and you should not expect it to stay private. Do not post personal data you do not want shared.
Licence to us. You grant us a non-exclusive, worldwide, royalty-free licence to host, store, copy, adapt, format, translate, publish, display, and otherwise use your User Content so we can operate, provide, and promote the Website and our services. This licence lasts as long as needed for those purposes and for our reasonable records and backups; it ends for active public use within a reasonable time after you delete your User Content or close your account, subject to the law. We may also use your name, username, and image together with your User Content for these purposes. Where the law (including in the EU) requires your consent for marketing use of your image or testimonial, we will ask for it, and you can withdraw that consent.
Your rights stay intact. Nothing here transfers ownership of your User Content to us, and this licence does not override privacy or data-protection rights you have. Moral rights are respected to the extent the law of your country requires.
Your promises. By posting User Content, you confirm that it is yours or you have the rights to post it, that our use of it as described will not infringe anyone's rights, and that it does not break the Acceptable Use rules below.
8. Acceptable use
By using the Website you agree to follow these rules. You will:
- use the Website only for lawful purposes and comply with all laws that apply to you;
- not post or share content that infringes anyone's copyright, trademark, privacy, publicity, or other rights;
- not post content that is defamatory, obscene, pornographic, or sexually explicit, that invades someone's privacy, that promotes violence, or that is hateful — that is, content attacking or demeaning people based on race or ethnicity, national origin, religion, disability, sex, age, veteran status, sexual orientation, or gender identity;
- not disclose another person's private information (such as their address, phone number, email, or payment details) without their consent;
- not stalk, threaten, harass, or abuse anyone;
- not spam, or use the Website for unauthorised commercial or promotional activity;
- stay on topic when you post in community areas;
- not use the Website to gather market research for a competing business;
- not impersonate any person or organisation, or misrepresent who you are;
- not introduce viruses or malicious code, or try to gain unauthorised access to the Website, its servers, accounts, or data;
- not disable or interfere with security or safety features, including any report or block tools;
- not use bots, scrapers, or other automated means to access or copy the Website without our written permission — though we allow public search engines to index our public pages; and
- not place an unreasonable load on our systems.
Please tell us at contact@carolinamelendez.co if you see content that breaks these rules. We may remove content, and restrict or suspend access, where we reasonably believe these rules have been broken. Where you are a consumer and we take action against your account, we will act proportionately and tell you the reason, so you can respond, unless the law prevents us or there is a legal or security reason not to.
9. Unsolicited ideas and feedback
We do not accept or review unsolicited creative ideas, proposals, or materials — for example concepts for books, courses, campaigns, products, services, or names. Please do not send them. This avoids misunderstandings if something we later develop happens to resemble an idea someone sent us.
If you send an unsolicited idea anyway, then whatever your message says:
- no confidential or special relationship is created between us by your sending it;
- material we create, acquire, or license independently may be similar or identical to your idea, and you will not be owed anything for our use of such similar material; and
- to the extent the law allows, you release us from claims arising out of any such similarity.
Feedback is welcome. We do want your feedback and questions about our existing products and services. Any such feedback is treated as non-confidential, and we may use it freely to improve what we do, without owing you payment or credit. Do not include confidential information in feedback.
10. Links to other websites
The Website may link to third-party websites. We provide these links for convenience only; a link is not an endorsement. We do not control these sites and are not responsible for their content, products, or privacy practices. If you follow a link, you do so at your own risk and should read that site's own terms and privacy notice. Any concern about a linked site should go to that site's operator.
11. Data protection and privacy
We take your privacy seriously. How we collect and use personal data is set out in full in our Privacy Policy, which forms part of this Agreement. This section summarises the framework; the Privacy Policy controls if there is any difference.
Who is responsible. For personal data we process about you, Carolina Melendez, established in the United Kingdom, is the data controller. You can reach us about data matters at contact@carolinamelendez.co. Our lead supervisory authority is the UK Information Commissioner's Office (ICO).
Laws we aim to comply with. We design our data practices to meet, as applicable to you:
- the UK GDPR and the UK Data Protection Act 2018 (our primary data-protection regime);
- the EU General Data Protection Regulation (GDPR), where we offer goods or services to, or monitor, people in the EU/EEA;
- the US federal and state privacy laws that apply to our users, including state laws such as the California Consumer Privacy Act (CCPA/CPRA) where relevant;
- Brazil's Lei Geral de Proteção de Dados (LGPD); and
- data-protection laws in ASEAN markets we serve, such as Singapore's Personal Data Protection Act (PDPA) and comparable laws in other ASEAN countries.
Your rights. Depending on the law that applies to you, you may have the right to access your personal data, correct it, delete it, restrict or object to its use, port it to another provider, and withdraw consent. Where processing relies on consent, you can withdraw it at any time without affecting earlier processing. To exercise any right, contact contact@carolinamelendez.co. You can also complain to your data protection authority — in the EU/EEA, your national authority; in the UK, the ICO; in Brazil, the ANPD; in Singapore, the PDPC.
International transfers. Because we operate online, your data may be processed in countries outside your own. Where we transfer personal data out of the EU/EEA, the UK, Brazil, or another protected region, we use a lawful transfer mechanism — such as the UK International Data Transfer Agreement or Addendum, the European Commission's Standard Contractual Clauses, an adequacy decision, or an equivalent safeguard under the law that applies — as explained in the Privacy Policy.
Legal bases and security. We process personal data only where we have a lawful basis (such as performing our contract with you, your consent, our legitimate interests, or a legal obligation) and we apply appropriate technical and organisational measures to protect it. Details, including retention periods and cookies, are in the Privacy Policy.
12. Disclaimers
We work to keep the Website and Content accurate and available, but, to the extent the law allows, the Website and Content are provided on an as is and as available basis. We do not guarantee that the Website will be uninterrupted or error-free, that defects will be fixed immediately, or that the Website or its servers are free of harmful components.
To the extent allowed by law, we disclaim implied warranties, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and warranties arising from a course of dealing or trade usage.
The Website may contain occasional errors or omissions. Unless the law requires otherwise, we are not responsible for typographical or pricing errors, and we may correct them and update the Website at any time. A product or service mentioned on the Website may not be available everywhere.
This section does not exclude what the law does not let us exclude. If you are a consumer, you have statutory rights and guarantees — for example under EU and UK consumer law, Brazil's Consumer Defense Code, and consumer laws in ASEAN and US jurisdictions — that are not affected by anything in this section. Nothing here limits those rights.
Educational content. Our Content is for education and general information. It is not professional, legal, medical, or financial advice, and results differ from person to person. Decisions you make based on the Content are your own.
13. Limitation of liability
What we never limit. Nothing in this Agreement limits or excludes our liability where the law does not allow it. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for a breach of your mandatory consumer rights, and for anything else that cannot lawfully be limited.
For consumers. If you are a consumer, we are responsible for loss you suffer that is a foreseeable result of our breaking this Agreement or failing to use reasonable care and skill. We are not responsible for loss that is not foreseeable, or for loss caused by your own breach of this Agreement. Your statutory remedies under the consumer law that applies to you remain available in full.
For business users. If you use the Website for business purposes, then to the extent the law allows: we are not liable for indirect or consequential loss, loss of profit, revenue, data, or goodwill, or business interruption; and our total liability to you arising out of this Agreement is limited to the amount you paid us in the three (3) months before the event giving rise to the claim.
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. In that case our liability is limited to the greatest extent the law allows.
14. Your responsibility to us (indemnity)
If you use the Website in a way that causes us loss, you agree to cover reasonable costs, damages, and expenses (including reasonable legal fees) that arise from: (i) your breach of this Agreement; (ii) your misuse of the Content or the Website; or (iii) your infringement of a third party's rights, such as copyright, trademark, privacy, or publicity rights.
This applies to the extent the loss was actually caused by you. If you are a consumer, this indemnity is limited to loss that results from your deliberate or negligent breach and never asks more of you than the law allows; it does not apply to ordinary, good-faith use of the Website. We will tell you promptly about any claim, will not settle it in a way that admits fault on your part without your agreement, and will give you the chance to take part in the defence.
15. Reporting infringing or illegal content
We respect intellectual property and other rights, and we act on valid reports. If you believe content on the Website infringes your rights or is otherwise illegal, send a notice to contact@carolinamelendez.co with:
- a description of the work or right involved;
- the exact location (URL) of the content on the Website;
- your name, address, phone number, and email;
- a statement that you believe in good faith the use is not authorised by the rights holder, an agent, or the law;
- a statement that the information in your notice is accurate; and
- your physical or electronic signature (and, if you act for the rights holder, confirmation that you are authorised to do so).
We will review valid notices and remove or disable access to content where appropriate. We may also suspend accounts of repeat infringers.
For US rights holders (DMCA). The above also serves as a notice under the US Digital Millennium Copyright Act. Our designated contact for DMCA notices is Expansion Publishing LTD, 71-75 Shelton Street, Covent Garden, London, United Kingdom, WC2H 9JQ, contact@carolinamelendez.co.
For users in the EU (Digital Services Act). If you are in the EU/EEA, you can use the same contact to flag illegal content under the Digital Services Act. We will handle notices diligently and in good time, tell you our decision and the reasons, and, where relevant, explain how you can contest it. We do not generally monitor content proactively, and acting on a valid notice does not mean we accept liability for the content.
16. Governing law and where disputes are heard
This Agreement is governed by the law of England and Wales, without regard to its conflict-of-laws rules.
Your consumer protections come first. If you are a consumer, this choice of law does not take away the protection of mandatory rules of the country where you live. In practice: a consumer in the EU/EEA keeps the protections of their own country's law; a consumer in Brazil keeps the protections of the Consumer Defense Code and may bring proceedings in their own domicile; a consumer in the UK, an ASEAN country, or the US keeps the mandatory consumer protections of their jurisdiction.
Where disputes go. Subject to those consumer protections and to the dispute-resolution section below, the courts of England and Wales have jurisdiction over disputes under this Agreement. A consumer may also bring proceedings in the courts of the country where they live, and may be sued only there.
If you use the Website as a business, you and we submit to the exclusive jurisdiction of the courts of England and Wales.
17. Resolving disputes
Talk to us first. Most problems can be sorted out quickly. Please contact us at contact@carolinamelendez.co before starting formal proceedings, and we will try in good faith to resolve the matter.
Consumers in the EU/EEA. The European Commission's Online Dispute Resolution (ODR) platform closed on 20 July 2025, so there is no longer an EU ODR platform to use. You may still be entitled to alternative dispute resolution (ADR), and in a cross-border dispute you can contact your national European Consumer Centre (ECC-Net). We are not obliged to use a particular ADR body unless the law requires it, and using any of these does not affect your right to go to court.
Consumers in Brazil. You keep all rights under the Consumer Defense Code, including access to consumer-protection bodies (such as PROCON) and the consumidor.gov.br platform, and the right to bring proceedings where you live. Nothing here forces you into arbitration.
Consumers in the UK, ASEAN countries, and elsewhere. You keep the right to bring a dispute before the courts or consumer bodies available to you under your local law.
Users in the United States (arbitration and class-action waiver). If you are based in the US and are not covered by a mandatory consumer protection that says otherwise, then for any dispute under this Agreement, either you or we may choose binding individual arbitration under the Federal Arbitration Act, instead of court, except that either party may still use small-claims court. Where this applies, you and we waive the right to a jury trial and agree that disputes will be handled individually, not as a class or representative action. This paragraph applies only to the extent it is enforceable for you; it does not apply to consumers whose law does not permit it, and it does not take away any non-waivable right.
Injunctions. Either party may ask a competent court for urgent or injunctive relief to protect its rights — for example to stop misuse of intellectual property — without this affecting the rest of this section.
18. Changes, termination, and general terms
Changes to these terms. We may update these Terms of Use to reflect changes in our services or the law. If a change materially affects you, we will give reasonable notice — for example by posting the new version with its effective date, or by emailing Registered Users. For continuing services, material changes take effect only after notice, and if you do not accept them you may stop using the service and, where relevant, cancel. Your continued use after a change takes effect means you accept it.
Changes to the Website. We may change, suspend, or discontinue parts of the Website. Where this affects something you have paid for, we will act fairly and in line with your consumer rights.
Termination. You may stop using the Website at any time and close your account. We may suspend or end your access where you seriously or repeatedly breach this Agreement, where the law requires it, or for security — proportionately, and with notice and reasons where we reasonably can. Sections that by their nature should survive — on payment, intellectual property, your content licence, disclaimers, liability, indemnity, governing law, and dispute resolution — continue after termination.
General.
- No waiver. If we do not enforce a term, that is not a waiver of it. A waiver is effective only if we give it in writing.
- Severability. If part of this Agreement is found invalid, the rest stays in force, and the invalid part is read down to what is lawful.
- Assignment. You may not transfer your rights or obligations without our consent. We may transfer ours to a successor (for example on a sale of the business) without reducing your rights.
- Entire agreement. This Agreement, the Privacy Policy, and any Terms and Conditions of Purchase are the whole agreement between us on this subject.
- Force majeure. Neither party is liable for delay or failure caused by events beyond its reasonable control.
- Language. These terms may be offered in other languages for convenience; if there is a conflict, the English-language version governs, except where your local law requires its own language to prevail for you as a consumer.
